Agreement to Terms

The following terms and conditions govern your use of the VPN services provided by Rosa VPN (the "Service") and its associated website domains (the "Site"). This Agreement is legally binding between you and Rosa VPN.

By downloading, installing, or using Rosa VPN, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Prohibited Uses

• DDoS attacks, fraud, identity theft, or distribution of malware or viruses
• Spam, unsolicited communications, or illegal content transmission
• Any activity that violates applicable laws or regulations in your jurisdiction

Service Limitations and Availability

What Rosa VPN Provides

• Secure connection to prevent data interception
• Server selection for optimal performance

What Rosa VPN Cannot Provide

• Complete anonymity (websites you log into can still identify you)
• Protection from malware or phishing attacks
• Guaranteed access to all websites or services
• Protection from legal consequences of illegal activities
• 100% uptime or uninterrupted service

Service Availability

Rosa VPN strives to provide reliable service, but we cannot guarantee:

• Uninterrupted service - Service may be temporarily unavailable due to maintenance
• Consistent speeds - Connection speeds may vary based on network conditions
• Universal access - Some websites may block VPN connections
• Server availability - Servers may be temporarily unavailable or changed

Free Service Model

Ad-Supported Service

• Rosa VPN is completely free to use
• Revenue comes from advertisements
• No hidden fees or subscription charges
• No data limits or usage restrictions

User Responsibilities

• Keep your device and app updated
• Be cautious with sensitive information
• Report security concerns immediately

Compliance

• Use the Service only for lawful purposes
• Respect intellectual property rights
• Comply with local laws and regulations
• Don't attempt to circumvent security measures

Third-Party Content and Services

Rosa VPN does not control, monitor, or endorse any third-party content, websites, or services accessed through our VPN. You access such content at your own risk. We are not responsible for the accuracy, legality, or content of any third-party materials.

Intellectual Property Rights

Dispute Resolution

If you have a dispute with Rosa VPN, we encourage you to resolve it informally before pursuing legal remedies. By using our services, you agree to the following process:

Informal Resolution First

Before initiating any formal proceedings, you agree to contact Rosa VPN at [email protected] and provide a written description of your concern. Both parties will attempt in good faith to resolve the dispute informally within 30 days.

Optional Mediation

If informal resolution is unsuccessful, either party may propose non-binding mediation, to be conducted by a mutually agreed-upon, neutral third party. Mediation will be conducted remotely unless both parties agree otherwise. Costs will be shared equally.

Arbitration or Court Proceedings

If mediation does not resolve the dispute:

• Residents outside Quebec: You agree that any unresolved dispute shall be submitted to binding arbitration, administered in accordance with the Arbitration Act (Ontario) or applicable provincial arbitration legislation.
• The arbitration shall be held in English, in Ontario, unless otherwise agreed.
• Each party will bear its own legal fees unless otherwise awarded by the arbitrator.
• Residents of Quebec: You retain your right to bring a claim in the courts of Quebec, as required under the Civil Code of Québec and the Quebec Consumer Protection Act.

Small Claims and Exceptions

Either party may still bring an individual claim in small claims court, or seek equitable or injunctive relief for matters such as intellectual property infringement or unauthorized access.

No Class Actions or Jury Trials

To the extent permitted by applicable law, you agree to waive any right to participate in class actions or collective proceedings. You also waive the right to a jury trial where allowed.

1. Service Warranties

• Our Service is provided on an "as is" and "as available" basis, without any warranties regarding accuracy, suitability, or uninterrupted service.
• Your use of the Site and Service is at your own discretion and risk.
• To the fullest extent permitted by applicable law, Rosa VPN is provided with no warranties or guarantees of any kind—express, implied, or statutory—including merchantability, fitness for a particular purpose, or non-infringement.

• The Site may include links to Third-Party Websites; however, accessing these links is at your own risk.
• Rosa VPN bears no responsibility for the content, accuracy, or reliability of Third-Party Websites.
• Users are encouraged to review the privacy policies of external sites.
• The app may use third-party services, and links to their privacy policies are provided below. Third-party service providers:

3. Security and Monitoring

• We prioritize security and employ industry-standard measures, but no method of transmission over the internet is entirely secure
• While we do not actively monitor user sessions, we reserve the right to investigate potential violations of our terms

Limitation of Liability

To the fullest extent permitted by applicable law:

• Rosa VPN is not liable for indirect, incidental, or consequential damages resulting from your use of the Service
• Our total liability is limited to the amount you paid for the Service (which is $0)
• We are not liable for data loss, security breaches, or third-party actions or content
• We are not responsible for any damages or losses caused by your use of the Service

Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where Rosa VPN operates, without regard to conflict of law principles. Any legal proceedings must be brought in the courts of our jurisdiction, and you consent to the personal jurisdiction of these courts.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

Entire Agreement

These Terms constitute the entire agreement between you and Rosa VPN regarding the Service. They supersede all prior agreements, representations, and understandings, whether written or oral.

Changes to Policies

• Rosa VPN reserves the right to update these policies.
• Users are advised to review periodically, and changes will be effective upon posting.
• Your continued use of the Service after changes are posted constitutes acceptance of the updated policies.
